Background

For the sake of promoting the diversity of research in International Law (IL) and contributing to the (re)construction of International Relations (IR) on the basis of dialogue, concertation and equality of law, several international institutes and organizations were created. In this regard, one can mention The International Law Institute (ILI) founded in 1873 in Gand in Belgium, The Hague Academy of International Law (Netherland) and The American Society of International Law (ASIL), founded in 1906. There are also several renowned scientific journals specializing in international law. Their contribution to advancing knowledge in various aspects of International Law is no longer to be proven. Three of them are particularly the most prestigious; these are The American Journal of International Law, The Nordic Journal of International Law and The European Journal of International Law.

Given the profound changes in the Arab World and the absence of a platform allowing researchers to express themselves freely on issues relating to International Law, it seems appropriate to set up a periodic review which could follow the progress of International Law. However, due to the practical difficulties associated with the sustainability over time of such a review, we propose, in a primary phase, to approach the state of International Law in its relations with the Arab World through the production of The Arab Journal of International Law (ARJIL).

To this end, a scientific reading committee made up of eminent researchers in the field has been set up. Its mission consists in evaluating, according to universally recognized academic standards, the papers which will be proposed by the researchers. In addition, the members of this committee also have the possibility of offering their contributions in order to enrich the content of the ARJIL.

 ARJIL’s field of interest extends to all disciplines of Public International Law, but also to its sociological (Sociology of International Law) and philosophical (Philosophy of International Law) foundations. 

Thus, the journal will focus on a variety of themes related to the economic sphere (International Economic Law and International Investment Law), the growth sphere (International Development Law), the ecological figure (International Environmental Law), the scope of human rights (International Human Rights Law) and the humanitarian area (International Humanitarian Law).

A special place will be given to critical questions linked to climate change, migratory flows and epidemics, which require a significant scientific and intellectual commitment on the part of researchers in International Law and more broadly in social sciences.

One of the major motivations behind the launching of this initiative is the insufficiency of studies linked to International Law and the various problems and tensions which shape the Arab World. ARJIL comes in handy to fill in this gap.

The geographical and institutional framework of ARJIL is the Arab World. However, we remain open to international variables and their various theoretical implications, as well as to the transformations underway on the international scene and the regional constructions of International Law (Case of the European Union).

ARJIL's objectives

ARJIL has the following objectives:

- Approach the questions of International Law from an academic angle by emphasizing the problems that arise on the Arab and international scenes. This would make it possible to capitalize on the opportunities and assets offered by scientific facts observed on an international scale in a context marked by strong inconsistencies;

- Deepen research on the questions and problems raised by International Law and their implications and effects on the Arab World;

- Analyze and develop the conceptual framework of International Law by adopting a broader approach focused on multidisciplinary and interdisciplinary perspectives through narrowing the gap between the different disciplinary fields in the social sciences (political science, sociology, philosophy, economics, history etc.).

Obviously, such an approach requires going beyond purely legal and normative studies.

Conditions for publishing articles

ARJIL will use an anonymous peer review process. The aim is to help the editorial team assess the contributions submitted to it in the most objective way possible, and to improve the papers’ quality through suggestions and constructive comments.

ARJIL accepts any original text written in Arabic, English or French for assessment.

The final text must reach the editor in Word format.

Authors should not submit their texts to other journals or publishers before having received the opinion of the editorial committee.

When a text is published by ARJIL, it cannot be published again, totally or partly, without permission from the editor.

Articles can be accepted, accepted after modifications or refused. The requested modifications may concern both the form and the content. It is the Editorial Committee that eventually makes the final decision about that.

Authors are invited to remove from their text any explicit allusion which would allow their identification by the experts.

Unpublished texts are not returned to their authors.

For the texts accepted for publication after expert appraisals, the authors must supply ARJIL, in addition to the summaries already provided, with:

- An abstract in one of the other two languages.

- A list of keywords (five maximum).

- Institutional affiliation.

- Email address.

Revue Arabe de Droit International

 

Argumentaire 

Afin d’encourager la  recherche dans le domaine du Droit International et contribuer ainsi à la reconstruction des relations internationales sur la base du dialogue, de la concertation et de l’égalité de droit, plusieurs instituts et organismes internationaux furent crées. Citons à ce propos  l'Institut de Droit International fondé en 1873 à Gand en Belgique, l'Académie de Droit International de La Haye et l'American Society of International Law (ASIL), fondée en 1906.

Il existe également plusieurs revues scientifiques de renommée spécialisées en droit international. Leur contribution à faire avancer les connaissances des différents aspects de cette spécialité n’est plus à démonter. Trois d’entre elles sont particulièrement les plus prestigieuses; il s’agit de l’American Journal of  International Law, du Nordic Journal of International Law et de l’European Journal of International Law.

Vu les profondes mutations que connait le Monde Arabe et l’absence d’une plate-forme permettant aux chercheurs de s’exprimer librement sur les questions qui se rapportent au Droit International, il semble  opportun de mettre en place une revue périodique qui pourrait suivre les progrès que connait le Droit International. Néanmoins, en raison des difficultés pratiques associées à la pérennisation d’une telle revue dans le temps, nous proposons  dans une première étape  d’approcher l’état de Droit International dans ses rapports avec le Monde Arabe à travers la production de la Revue Arabe de Droit International (ARJIL).

Pour ce faire, un comité de lecture scientifique composé d’imminents chercheurs dans le domaine a été constitué. Sa mission consiste à évaluer,  selon les normes académiques universellement reconnues, les papiers qui seront proposés par les chercheurs. Par ailleurs, les membres de ce comité ont aussi la possibilité de proposer leurs contributions afin d’enrichir le contenu de l’Annuaire.

Le champ d’intérêt de l’ARJIL s’étend à toutes les disciplines du Droit International Public,  mais également à ses fondements  sociologiques (Sociologie du Droit International) et philosophiques (Philosophie du Droit International). 

Ainsi, l’annuaire portera sur une diversité de thématiques en  relation avec la sphère économique (Droit Economique International et Investissement International),  la sphère du développement (droit International pour le Développement), la sphère de l’environnement (Droit International de l’Environnement),  la sphère des droits de l’homme  (Droit International des droits de l’homme) et la sphère humanitaire (Droit International Humanitaire).

Une place particulière sera accordée aux questions urgentes liées au changement climatique, aux flux migratoires et aux épidémies, qui nécessitent  un engagement scientifique  et intellectuel  important de la part des chercheurs en Droit International et en sciences sociales en général.

L’une des motivations majeures qui nous ont guidées dans le lancement de cette initiative est l’insuffisance des études qui mettent en relation le Droit International et les différentes problèmes et tensions qui traversent le Monde Arabe. L’ARJIL se veut alors une réponse à cette pénurie d’études.

Un tel projet  met l’accent sur les diverses préoccupations qui agitent aujourd’hui un Monde Arabe très ouvert sur l’autre et s’inscrit dans une perspective plus ambitieuse: celle de créer une revue spécialisée portant le  nom de la Revue Arabe du Droit International; l’RADI).

Le cadre géographique et institutionnel de l’ARJIL est le Monde Arabe. Cependant, nous restons ouverts sur les variables internationales et leurs diverses implications théoriques, ainsi que sur les transformations en cours sur la scène internationale et les constructions régionales du Droit International (Cas de l’Union européenne par exemple).

Les objectifs de l’ARJIL

L’ARJIL vise les objectifs suivants:

- Approcher  les questions du Droit International  sous un  angle académique en mettant l’accent sur les problèmes qui surgissent sur les scènes arabe et internationale. Cela permettrait  de tirer parti des opportunités et des atouts qu’offrent  les faits scientifiques observés à l’échelle internationale dans un contexte marqué par de fortes incohérences;

- Approfondir la recherche sur les questions et les problèmes soulevés par le Droit International et leurs implications et effets sur le Monde Arabe;

-  Analyser et développer le cadre conceptuel du droit international en adoptant une approche plus larges axées sur la pluridisciplinarité et l’interdisciplinarité et ce, afin de contribuer, autant que faire se peut, à changer la façon de penser les questions internationales et  servir les intérêts et causes de la société arabe;

- Encourager la production de recherches analytiques et critiques qui vise l’ouverture du Droit International sur d’autres disciplines et le rétrécissement du fossé qui sépare les différents champs disciplinaires en sciences sociales (la science politique, la sociologie, la philosophie, l’économie,  l’histoire etc.).

A l’évidence, une telle démarche nécessite d’aller au-delà des études purement juridiques et normatives.

Les conditions de publication des articles 

L’ARJIL aura recours  à un processus d'examen anonyme par les pairs. Le but est d’aider l'équipe éditoriale à évaluer les contributions qui lui seront soumises de la façon la plus objective possible, et à améliorer leur qualité grâce à des suggestions et des commentaires constructifs.

L’ARJIL accepte pour évaluation tout texte original rédigé en arabe, en français ou en anglais.

Le texte final  doit parvenir à la rédaction sous la forme d’un fichier au format Word.

Les auteurs ne peuvent soumettre leurs textes à d'autres revues ou éditeurs avant d'avoir reçu l'avis du comité de rédaction.

Lorsqu'un texte est publié par l’ARJIL, il ne peut l'être de nouveau, en tout ou en partie, sans autorisation à demander à la rédaction.

Les articles peuvent être acceptés, acceptés après modifications ou refusés. Les modifications demandées peuvent concerner aussi bien la forme que le contenu. C’est le Comité de rédaction qui statue en dernier ressort.

Les auteurs sont invités à supprimer de leur texte toute allusion explicite qui permettrait leur identification par les experts.

Les textes non publiés ne sont pas renvoyés aux auteurs.

Pour les textes acceptés pour publication après expertises, les auteurs devront fournir à l’ARJIL, en plus des résumés déjà fournis:

– un résumé dans les deux autres langues.

– le titre de l’article traduit dans les deux autres langues.

– une liste de mots clés (cinq max).

– l’appartenance institutionnelle.

– l’adresse électronique.

المرجعية النظرية للكتاب العربــي السّنوي للقانون الدولي

أُحدِثت، بغرض تشجيع البحث في مجال القانون الدولي، والإسهام في (إعادة بناء) العلاقات الدولية على أسس الحوار والتّشاور والمساواة أمام القانون، معاهد ومؤسسات وجمعيات أكاديمية بحثية عريقة في القانون الدولي؛ منها: معهد القانون الدولي (International Law Institute) في مدينة غنت (Ghent) البلجيكية منذ 1873؛ وأكاديمية القانون الدولي بلاهاي (The Hague Academy of International Law) بهولندا منذ 1923، والجمعية الأمريكية للقانون الدولي (The American Society of International Law, ASIL) منذ 1906.

كما وُجدت مجلات عريقة فــي القانون الدولـي؛ منها: المجلة الأمريكية للقانون الدولي (American Journal of International Law) منذ 1907، ومجلة دول الشمال للقانون الدولي (Nordic Journal of International Law) منذ 1930، والمجلة الأوروبية للقانون الدولي (European Journal of International Law).

وبالنظر إلى التحولات العميقة التي يشهدها العالم العربي من جهة، وغياب أرضية مشتركة تسمح للباحثين بمناقشة قضايا القانون الدولي بحرية من جهة ثانية، يبدو أساسياَ إصدار مجلة دورية قصد مناقشة شؤون القانون الدولي، وانعكاسات ذلك على العالم العربي. لكن في ظل الإكراهات المالية، وتعقيد الإجراءات والمساطر الإدارية، سنعمل في المرحلة الأولى على إصدار الكتاب العربي السنوي للقانون الدولي. وبهدف إنجاح المشروع، أحدثنا ثلاث لجان علمية متميزة مكلفة بتحكيم الدّراسات (باللغة العربية أو الفرنسية أو الانجليزية)، وفق المعايير المتعارف عليها عالميا، مع إمكانية مشاركة أعضاء اللجنة العلمية في إغناء مواد الكتاب العربي السّنوي للقانون الدولي.

    مجالات الاهتمام العلمية

يهتم الكتاب العربي السّنوي للقانون الدولي بكل مجالات القانون الدولي العام وأُسُسه الاجتماعية (سوسيولوجيا القانون الدولي)، والفلسفية (فلسفة القانون الدولي)، وارتباطاته الاقتصادية-الاستثمارية (القانون الدولي الاقتصادي والاستثمار الدولي)، والتنموية (القانون الدولي للتنمية)، والبيئية (القانون الدولي البيئي)، والحقوقية (القانون الدولي لحقوق الإنسان)، والإنسانية (القانون الدولي الإنساني). إضافة إلى وجود القضايا الضاغطة على المجتمع الدولي، كالتّغيرات المناخية، والهجرة، والأوبئة التي تستدعي الاهتمام والبحث والرصد الأكاديمي.

ومن بين الملاحظات الهامة التي أثارت اهتمام القائمين على مبادرة الكتاب العربي السنوي للقانون الدولي، النقص الواضح في الرّبط بين القانون الدولي والإشكالات المتعددة التي تخترق العالم العربي؛ وهو ما سنسعى لتداركه عبر التركيز مبدئيا على قضاياه وانشغالاته، بوصفها قيمة مضافة ونوعية للكتاب العربي السنوي للقانون الدولي. فالمجال العربي هو التربة الخصبة والمرجعية الأساسية للكتاب العربي السّنوي للقانون الدولي، دون إهمال المتغيرات الدولية وآثارها النظرية، وكذلك التحولّات التي تطرأ على المجتمع الدولي وأنساقه، ومختلف التّطبيقات الإقليمية (كما هو الحَال في الاتحاد الأوروبي) للقانون الدولي العام.

    أهداف الكتاب العربي السّنوي

-         يهدف الكتاب العربي السّنوي إلى مُقاربة قضايا وإشكالات القانون الدولي العام من منظور علمي، يركز على القضايا العربية الإقليمية والدولية، من أجل الاستفادة من الفرص والمصالح التي تتيحها الحياة الدولية في سياق عدم اتساق النّسق الدولي.

-         تعميق البحث حول رصد ومناقشة وتحليل القضايا والإشكالات المُثارة في القانون الدولي ضمن تداعياته وتأثيراته على العالم العربي.

-         الانطلاق من تحليل المصطلحات والمفاهيم أو تطويرها (في ظل تداخل الاختصاصات المعرفية وتداخل المناهج) من أجل الإسهام، ولو جُزئيا، في تغيير بوصلة التفكير في القضايا الدولية وخدمة مصالح المجتمع العربي وقضاياه.

-         تُعطى الأولوية للبحوث التّحليلية النّقدية للقانون الدولي وتجسير الهوة بين مختلف الحقول الاجتماعية (كعلم السياسة وعلم الاجتماع والفلسفة والاقتصاد والتاريخ)، وَتَجَاذُبَاتِهَا السياسية والاقتصادية، وهو ما يعني حتماً تجاوز الدراسات القانونية والمعيارية.

     شروط النّشر في  الكتاب العربي السّنوي للقانون الدولي

-         تُقبل الأبحاث المبنية على أسس ومعايير علمية في الكتابة والتوثيق، والتي لم تُنشر من قَبْل.

-         تخضع جميع الدراسات والأوراق إلى تقييم المختصين  والمدققين.

-         يُنشر الكتاب العربي السّنوي الأبحاث المقبولة بالعربية والانجليزية والفرنسية.

-         لا يدفع الكتاب السنوي أي مكافأة مادية عن النشر، ولا تتقاضى المجلة أي رسوم على النشر فيها.
